THE SAWMILL HAS BEEN DEFEATED!!!

It is with great pleasure that we announce the Massachusetts Appeals Court ruled on 4/17/19 that Harry Jekanowski’s pathetic and illegal attempt to help his fellow Cialis Crew criminals failed. Harry had filed a motion in opposition to Tim Fondakowski’s request to protect himself against the criminals that run Westhampton and their criminal law firm, KP Law. Harry’s motion contained ZERO court cases that supported his position. But because Harry Jekanowski knows how well corruption works in Massachusetts, he knew he could file the fake motion to put financial strain on Fondakowski and that Jekanowski wouldn’t get in trouble unless someone like the FBI were looking at the case. Can you believe a Clerk of Courts like Harry Jekanowski can be used by other criminals, like Katie Laughman and Patrick Melnik, Sr., to help further their Fraud on the Court and he gets to keep his job and freedom?

Tim Fondakowski is now free to sue the Town of Westhampton and all of their agents individually for the criminal conspiracy he has been subjected to. We hope Tim bankrupts every last Cialis Crew criminal and their entire families. The Cialis Crew will find out their municipal immunity went away for each of them once they continued to commit crimes against Fondakowski after being notified of the same in 2017.

The Special Permit is now cancelled because it has not been used for two years since it was issued. That means Cotton and Melnik took $400,000 worth of land from Mary Challet because they promised they would put a sawmill there. Now they can’t put a sawmill there. That crime is called Financial Exploitation of the Elderly.

Call District Attorney David (aka Longmeadow Pedophile Protector) Sullivan and tell him to arrest David Cotton and Patrick Melnik, Sr. for Financial Exploitation of the Elderly. Call Police Chief David White and tell him to arrest David Cotton and Patrick Melnik, Sr. for Financial Exploitation of the Elderly. Demand that these “men” do the jobs that you pay them to do or demand their firing!

By the way, Cialis Crew, you have not suffered for your crimes. You have not paid any consequences for your crimes. And because you are such fools, you continue to live amongst the very victims of your crimes reminding them each day what you did to them. Smart!!

You were told that there would NEVER be a sawmill on Northwest Road, but because you’re the Cialis Crew, you didn’t listen. Fools never listen nor do they believe in God.

MEET TERRIFIED TOM HATHAWAY

Most small towns have someone who epitomizes the phrase: “A big fish in a small pond.” The little Western Mass town of Westhampton is no different. Meet Terrified Tom Hathaway – the most important person in Westhampton – just go ask him at Outlook Farm any morning or swing by a Planning Board meeting one night and ask him how he gets away with it all!

Tom’s role in the sawmill conspiracy was to get it passed no matter what laws were violated. With his little flaccid side-kick, Mumbles Schwallie, they set out to do what any sane person would know is impossible – get people on a residential road to voluntarily allow their property values to be destroyed by an illegal project based on fraud.

If you weren’t forced to spend two years of your life going to Tom and Mumbles fraudulent Planning Board meetings, here’s a brief synopsis of Terrified Tom’s role in the sawmill criminal conspiracy:

1. First Hearing: Terrified Tom announces to the few in attendance that he thinks Cotton’s sawmill deal is fine and should be approved that day – just like he and Schwallie voted and approved Blowhard Bill’s illegal Special Permit for his illegal sawmill the same day.
2. Second Hearing: Mark Challet, a former abutter to Cotton’s illegal sawmill, brought pictures of the extensive environmental damage caused by Cotton’s old dilapidated trucks leaking oil and other fluids. Terrified Tom took the pictures and then loudly announced: “I wonder who trespassed to take these pictures?” A new Northwest Road resident asked Terrified Tom to repeat what he said and asked the Planning Board note taker to ensure that what Terrified Tom had just said was recorded in the notes.
3. Guess what happened to the “big fish in a small pond” after that meeting? He never spoke publicly again at any sawmill meeting. Hence his nickname, Terrified Tom Hathaway. You proved you’re a cowardly beta male, Terrified Tom. Congrats!
4. What residents didn’t know at the time was that Terrified Tom was in the process of getting NUVO Bank to lend him $826,000 for a piece of property in Westhampton that is only valued at $188,200. We’ll get to that transaction shortly.
5. Terrified Tom also helped Melnik and Cotton by not appearing for a January Planning Board meeting because Terrified Tom had to “suddenly” go to a NASCAR race. The residents of Westhampton that arrived for the Planning Board meeting found that out on the steps of Town Hall. Melnik and Cotton had already been tipped off and were not there. Because Terrified Tom is so important in his own eyes, he thought that was the best way to treat the residents of Westhampton – with contempt and derision.
6. Terrified Tom also previously destroyed the marriage of a Westhampton couple who is involved in the sawmill nightmare. Stud master extraordinaire, Terrified Tom, perhaps should have recused himself from the sawmill hearings due to this moral conflict; don’t you think? Would you want the proud, adulterous, lying fornicator that destroyed your loved one’s marriage to be deciding if an illegal sawmill should destroy your home value too?
7. So, Terrified Tom thinks that you can break the laws of a Town while a sitting member of the Planning Board, vote twice to approve an illegal sawmill on a residential road which will destroy Northwest Road residents’ home values, sit in on the May 2017 Town meeting while the Cialis Crew lies to the entire Town and everyone will go home, be quiet and grab their ankles for you? Sure thing, Terrified Tom.

TERRIFIED TOM HATHAWAY HAS BEEN CHEATING WESTHAMPTON OUT OF TENS OF THOUSANDS OF DOLLARS IN PROPERTY TAXES SINCE AUGUST 2014.

Here’s the proof:
1. July 14, 2014 Planning Board member, Thomas Hathaway, forms ARTH LLC whose purpose is “Owning and Investing in Real Estate.” Terrified Tom is so cute to name his LLC after Westhampton’s most famous bank robber, Selectmen ARTHur Pichette.
2. July 24, 2014, ARTH LLC buys 39 Hooker Road for $250,000. A single family residentially zoned home. Attorney Roger Lipton is involved in the transaction.
3. July 31, 2014, ARTH LLC is granted a Commercial Mortgage from NUVO Bank for $200,000. Attorney Roger Lipton is involved in the transaction.
4. July 31, 2014, ARTH LLC signs a Collateral Assignment of Leases and Rents stating that NUVO bank REFUSES to lend the $200,000 without a Commercial Mortgage and Security agreement. Attorney Roger Lipton is involved in the transaction.
5. August 28, 2014, the same NUVO Bank Vice President, Michael P. Buckmaster, now agrees to lend ARTH LLC $826,000 once ARTH represents to the bank that they can strip mine the land in the event of a default. NUVO Bank is now telling its shareholders the property is worth $1,032,500 and that is why they are lending 80% of the value to Terrified Tom. Attorney Roger Lipton and Attorney Jeffrey L. Flalky are involved in the transaction.

So, of course, after Terrified Tom finished with these transactions that were overseen by at least two attorneys, he went and notified the assessors office that 39 Hooker Road is now a commercial property valued at $1,032,500, right? Well, the Town of Westhampton carries that property as of 2019 as a residential home valued by DELORES THORNHILL at $188,200. Look up 39 Hooker Road on Google maps and ask yourself why DELORES THORNHILL would call a massive mining operation a residential property – five years in a row. There’s only one reason – to help someone to purposely evade paying taxes. Oops, that’s a felony, DELORES.

Funny how DELORES THORNHILL could write an affidavit in 2017 to help Melnik and Cotton violate Fondakowski’s 4th Amendment rights with only a few weeks’ notice, but she can’t correctly classify Terrified Tom’s property after FIVE YEARS? So, instead of having to pay about $20,000 per year for his million-dollar property, Terrified Tom has only been paying the Town under $4,000 per year – making everyone else’s property taxes go up by the $15,000-$16,000 a year that Terrified Tom has been able to evade in property taxes with DELORES THORNHILL’s help or utter incompetence – which one is it DELORES? Are you that stupid at your job or are you that stupid as a co-conspirator in committing tax fraud, DELORES?

That means that at the same time Terrified Tom Hathaway was screwing everyone on Northwest Road by trying to destroy our property values with an illegal sawmill and 15 meetings, he was evading tens of thousands of dollars in property taxes with the help of DELORES THORNHILL. Almost five years of tax evasion would cause any other town to immediately fire Tom Hathaway from the Planning Board and refer him for criminal prosecution with Smart Steve Gagne’s office. But try to remember that this is Westhampton where there is no law enforcement against the Cialis Crew. Wait a few weeks and the Select Board will probably write a letter of support for Terrified Tom and DELORES THORNHILL like they did for Birdbrain Val.

So, who do you notify to collect this money and have Terrified Tom be held accountable for tax evasion? The Select Board -- which never met a law it wouldn’t break to help out a Cialis Crew member? Smart Steve and the Finance Committee – they’re still authorizing payments to KP Law to keep KP Law’s fraud on the court going. Smart Steve’s DA’s office won’t prosecute anyone committing crimes against Northwest Road residents – see their cover-up for Timmy Symington, Alan Loud, the still unnamed Cotton log dropper and the financial exploitation of the 80 year-old Challets. DELORES THORNHILL and the Assessor’s Office – the same DELORES THORNHILL that helped with the first raid on Fondakowski’s property or thinks a commercial mining operation should be classified and taxed as a single-family residence? Hey maybe we could contact Chief White and he would investigate like he did with the attacks and harassment against Tim and Robert Fondakowski – oh, that’s right, Westhampton Police don’t investigate Cotton crimes or that of his co-conspirators. Hey, wait, we’ll contact Tom Quinlan, the building commissioner. Yeah, just watched Honest Tom’s video again – he can’t read a map. No, we’ll get the Town counsel involved, Katie Laughmann at KP Law, she’ll know what to do to collect unpaid taxes and help our Town, right? After all, she found a way for Dave Cotton to not pay all of the fines he owed our Town. Oh, that’s right, Katie Laughmann, according to Warrior Phil, hatched the whole lie that the Town wouldn’t win in Court, so she’s a criminal too -- helping Cotton to break our laws, working against the best interests of the Town that pays her and lying to the Court in which she practices her “craft.” In fact, Katie is so diametrically opposed to the best interests of Westhampton that once her law firm found out that Pat Melnik was the friend and personal lawyer of Chuck Miller THEY DID NOTHING.

Terrified Tom should be happy that NUVO Bank was bought by Merchants Bank. He should also be happy that Community Bank bought Merchants. His loan seems to have slipped through the due diligence for those two transactions. Guess what? Community Bank is now buying Tenderhook Financial which means there are very interested parties involved again. Will these banks complete their merger carrying a loan they value at $826,000 to their public shareholders which is only secured by $188,200 worth of real estate according to DELORES THORNHILL?

Do you see what it is like to live in Westhampton, Massachusetts at present? It is lawless. It is run by a group of criminals who have taken over every aspect of our Town’s government and have and will break any law to get what they want. But, hey, no one is going to find out what you did because it is all legal; right, Terrified Tom? It must be legal because attorneys are involved, right, quiet, little race car fan? Vroom, vroom.

To give you a small preview of that experience, the highly esteemed lawyer, Michael Pill, famously asked the two Westhampton residents in his lair that day: “Haven’t you heard that people with money get their way?”

Below you will also see that Tim Fondakowski tried to settle his lawsuit against the Town a year ago. Did the Town respond or counter offer? Warrior Phil, Gossipy Jim and Alcoholic Art never responded to Fondakowski’s settlement proposal which simply asked all of the criminals to leave government. If this case was settled a year ago we never would have found out about Terrified Tom Hathaway’s tax evasion or Birdbrain Val and the rest of the Cialis Crew’s violation of Fondakowski’s 4th Amendment Rights. The greatest thing the Cialis Crew has done for Northwest Road residents since May 2017 is to try to cover-up their crimes because it only provides more incontrovertible evidence of their guilt and has allowed them time to commit more documented crimes. In other words, just because you resign DELORES doesn’t mean that you can’t be found guilty of conspiring with Terrified Tom to evade taxes or conspiring with the Cialis Crew to violate Fondakowski’s 4th Amendment rights. Those are felonies, DELORES!

DIRT POOR DEMPSEY AND WARRIOR PHIL MOCK A JUDGE’S RULING AND ENSURE THEY WILL BE DEFENDANTS IN ANOTHER LAWSUIT

It seems hard to believe, but Warrior Phil, now joined by the impoverished snow shoveler, Maureen Dempsey, had to make sure that everyone in the world knows that they are fully supportive of Birdbrain Val’s violation of a cancer patient’s Fourth Amendment Rights. Their letter is reminiscent of the “forethought” Warrior Phil put into his letter to the editor about the sawmill where he admits to breaking by-laws to help Cotton. Thank you so much for being the adversary you are, Warrior Phil!

After reading that Maureen Dempsey asked the Town to reimburse her and her husband for shoveling a little bit of snow, we thought the name, Dirt Poor Dempsey, would help people in Town to better understand her situation. If you live here long enough, you’ll find a lot of people involved in Westhampton government who also try to benefit financially from it, just ask the Dowlings, Pichettes, Tracys, Hathaways and Blakesleys to name a few.

Dirt Poor Dempsey and Warrior Phil signed a letter saying that they found Birdbrain Val’s “conduct and work exemplary.” They wrote this because Judge Fields found Birdbrain Val’s behavior so alarming that he forbade Birdbrain Val from entering his Court without an attorney accompanying her. They were helping a co-conspirator, Birdbrain, who they thought would do the same for them when they are caught. Because there is honor among thieves, right?

Birdbrain Val must have forgotten to mention to her Select Board co-conspirators that Judge Fields told Tim Fondakowski that he can bring an action in his Court for the Town violating his Fourth Amendment rights. Birdbrain Val probably also didn’t tell her co-conspirators that she vociferously denied that she was involved in the first raid on Fondakowski’s property. Birdbrain insisted to the Judge that the other Foothills health agent was responsible. Go get a copy of the transcript to see what Birdbrain said about her co-worker and ask yourself if you’re next to be thrown under the bus by Val. Did you have a good trip to Italy, Birdbrain?

Warrior Phil and Dirt Poor Dempsey, thank you so much for putting in writing that you “give our praise and full support to Valerie Bird” because she violated a Westhampton resident’s Fourth Amendment rights. It will make it much easier to name you as individual defendants. Better hope for a lot of snow this winter, Dirt Poor Dempsey, having to pay lawyers is expensive – continuing to sell eggs by the roadside probably won’t cut it. Maybe Blowhard Bill will share some of his moderator fee so you could hire someone as qualified as Pat Melnik?

We wanted you to have false hope – just like your wife had false hope that you wouldn’t continually cheat on her.

Thanks for starting your war against Northwest Road residents in 2014, Terrified Tom. We know you were the driving force to help Cotton. We hope we’re acting just like you thought victims of your crimes should act because we all know that you’re the smartest and toughest guy you ever met in Westhampton, right, Terrified Tom?

WESTHAMPTON POLICE SERGEANT, FLOYD FISCHER, COMMITS OBSTRUCTION OF JUSTICE UNDER COLOR OF LAW

On October 10, 2018, a still unidentified Cotton Tree Service worker attempted to murder Tim Fondakowski and his father, Robert, as they drove by 109 Northwest Road by dropping a large log at their car. Tim Fondakoski contacted the police within minutes and even sent pictures of the log and truck.

When Tim Fondakowski went to the Westhampton Police Department to report the crime in person, he was told by Sergeant Floyd Fischer that he is "not allowed to discuss anything about the incident ... if you want to talk outside privately, we can do that." Fischer has previously told Tim: "The Selectmen have told me I am not allowed to get involved in the Cotton deal." For obstructing justice under color of law and conspiring to obstruct justice with the Selectmen, Sergeant Floyd Fischer must be removed from his job immediately for the safety of Westhampton residents.

Chief Dave White didn't pick up a phone and call Dave Cotton to ask him who was operating the log truck when he got Tim's text of the crime. Cotton would have known because he has a tiny company. Chief White could have also just asked Dave Cotton, who proudly stood in front of 109 Northwest Road smiling and waving to passing cars all during October, but he didn't do that either. Instead, Chief White, a week later, asked an elderly neighbor if she saw the guy operating the log truck.

No investigation was apparently done by Chief White until a reporter called him and asked him about the attempted murder -- because people's memories improve with time, right? Only then, on October 17, 2018, did Chief White seek to interview Robert Fondakowski. But Chief White didn't interview Robert Fondakowski pursuant to normal police practices. He did a "Cialis Crew Cop Stop" probably after consultation with Warrior Phil.

Chief David White of the Westhampton Police Department on or about Wednesday, October 17, 2018, pulled a U-turn and followed Robert Fondakowski's car for about a half mile on Northwest Road and then turned on his flashers and made a traffic stop. Robert Fondakowski was not stopped for a motor vehicle violation. Chief White briefly asked him what happened at 109 Northwest Road SEVEN DAYS EARLIER, asked Robert who Tim had spoken to at the FBI and DA's office, and told Robert that "You know us, we're on Tim's side."

The real reason behind the traffic stop now starts to become Cialis Crew clear. Chief David White then called Robert Fondakowski TWICE the next day to get the names of the FBI agents - which, of course, had nothing to do with the log drop incident. Those two calls and the traffic stop clearly demonstrate Chief White's abuse of his power by intimidating a witness/victim of a crime. Morover, Chief White and the Town of Westhampton refuse to sign for certified mail from Tim Fondakowski.

Even though citizens have asked for police reports, Chief White's last response to the citizens on Northwest Road on November 12, 2018 only says that "Your harassment case will be brought to the court for review at some point this week. The log drop indident will be referred to the DA's Office after that." Chief David White wants us to believe that the attempted murder of a Westhampton resident does not require a personal interview with the actual victim and that he has collected enough evidence to send the case to prosecutors? Remember, Tim has never been interviewed.

If you wanted to ensure that the DA's office comes back saying not enough evidence -- this is the way to go! Maybe Chief White attended the same willful blindness workshop as Smart Steve, Jen Sattler, David Sullivan and Linda Pisano? Who was operating the log truck that day? Why haven't the police interviewed Tim? Why no photo line-up for Tim and Robert to view if the case is being sent to prosecutors? Oh, that's right, that would produce evidence against Cotton Tree Service.

Chief White has also refused to arrest Alan Loud, another Cotton Tree Service worker, who had harrassed Tim Fondakowski for months. Chief White always told Tim to go to court to report the harassment rather than conducting a police investigation. Chief White reassured Tim after the second incident of harassment that he had spoken to Alan Loud and there won't be any more harassment. (In case you forget what type of "men" they are, Dave Cotton and Pat Melnik sat behind Cheryl Silvernail the last time they lost in court and spoke loudly about the ex-cons who work for Cotton. It seemed like they thought that would intimidate her.)

On October 18, 2018, Alan Loud tried to run Tim Fondakowski off the road while driving a Cotton Tree Service truck. This was his third time harassing Tim Fondakowski in two months -- all reported to Chief White. Tim Fondakowski attended a MA State police photo line-up on November 2, 2018 and correctly identified Alan Loud. As of Janaury 1, 2019, Alan Loud has not been arrested and NO ONE from any law enforcement agency has contacted Tim Fondakowski about Alan Loud or the Cotton Tree Service attempted murder on October 10, 2018.

The criminal Select Board of Westhampton has now used your real estate tax money and a corrupt Planning Board, corrupt Town Counsel, two corrupt Building Inspectors, corrupt Health Inspector and two corrupt Westhampton police officers to help protect David Cotton and to threaten and harrass an innocent, lifelong Westhampton resident suffering from brain cancer.

HOW MAUREEN DEMPSEY, ART PICHETTE AND PATHETIC PHIL VIOLATED A WESTHAMPTON RESIDENT'S FOURTH AMENDMENT RIGHTS

We hope you all had a great Christmas. As you enjoy this time of the year celebrating the birth of Jesus, we wanted to make you aware of how the Cialis Crew plotted to criminally harass Tim Fondakowski and violate his Fourth Amendment rights as a nice pre-holiday "gift" from the criminal Select Board of Westhampton.

Maureen Dempsey (she is the daughter-in-law of Blowhard Bill Tracy), Alcoholic Art, PC Phil, Valerie Bird, Honest Tom Quinlan, David the Dumpster Blakesly, and Little Tommy Martin came up with a criminal conspiracy to make false statements to a court in an attempt to harass their legal opponent, Tim Fondakowski -- you know, the brain cancer patient who has never violated the law? This is the type of person that Maureen Dempsey and Tom Martin are -- pathetic, little liars who use your tax money to commit crimes against innocent, vulnerable Westhampton residents. Your children must be so proud to know their parents harass an innocent person suffering with brain cancer!! Do you beat little kittens for laughs, too?

These people illegally misused your tax money to go into court and claim that Tim Fondakowski was living on Northwest Road . This plot was publicly hatched at the September 6, 2018 Westhampton Board of Health meeting. Tom and Dave stated to the Town that "the board has concerns concerning 335 NW rd". Those "concerns" were one anonymous complaint and a one time observation by Blakesly that frost or dew was on one of Tim Fondakowski's cars early one morning. That means Little TOM MARTIN sat there on September 6th as the distinguished Chairman of the Westhampton Board of Health and said "Gee, Dave, seems like you're really on to something. Oh, and you have an anonymous complaint also? Let's get Val involved and get to the bottom of this horrible lawlessness immediately!!" Hey, Tom, he has brain cancer. Do you often bully vulnerable people, Tom? This was the second attempted raid on Fondakowski’s property by Martin's Board of Health. The first included Sergeant Floyd Fischer of the Westhampton police department when they raided Tim’s home because they had ONE ANONYMOUS COMPLAINT that Tim was NOT living there.

So, Dumpster Blakesly apparently drives around Town in that yellow highway supervisor truck spying on Westhampton residents while they sleep (or maybe it is only on residents who oppose Cialis Crew crimes?). Birdbrain Val, a liar who claims she drives on Northwest Road each day on her way to work from her home in Windsor (Valerie is as stupid and dishonest as Honest Tom Quinlan) went to court and presented Judge Fields with her "evidence" that Tim was living on the property. The judge didn't agree with Valerie's "evidence" or her violation of Tim's Fourth Amendment rights. In fact, Valerie and Tom were such a disgrace to the Court, that the Judge ordered the Town of Westhampton to NEVER appear in Court without an attorney present and to actually have evidence and witnesses -- "provide a description of each reason upon which the motion is based and the name of each witness involved." Only in criminal Westhampton would Birdbrain Val keep her job after such a rebuke from a Judge.

Dumpster Blakesly, through his handlers Art, Maureen and Phil, is now asking your Town to spend hundreds of thousands of dollars so he can slide his obese carcass into a really expensive truck to spy on Westhampton residents. The Cialis Crew thinks spending this money for Blakesly is a great reward for his collusion throughout the sawmill conspiracy (Dave also illegally did a fake traffic study for Mumbles Schwallie and Hathaway to help Cotton violate our by-laws), just as they wanted you to spend millions for the police in Town and you wisely voted "no."

But, the collusion runs really deep here and as you continue reading you will be thrilled you weren't conned into giving millions to the Westhampton Police Department by lying Phil Dowling. To help everyone understand why we are living in a lawless Town regarding the sawmill, our next update will feature how the Westhampton Police Department has committed obstruction of justice under color of law by refusing to investigate crimes committed against Tim Fondakowski and his father on four separate occasions by Cotton Tree Service employees in the fall of 2018 -- the same time Dumpster Dave, Little Tom, Honest Tom Quinlan and Birdbrain Val were plotting to criminally harass Tim in the courts and violate his Fourth Amendment rights.

According to Sergeant Floyd Fischer, the reason the Westhampton Police Department doesn’t investigate Cotton Tree Service felonies committed against Westhampton residents is because the Selectmen of Westhampton told them not to. In other words, the police in Westhampton openly admit they are criminals conspiring with the Select Board of Westhampton to help David Cotton and Pat Melnik. The same day a Cotton tree worker attempted to murder Tim and his father as they drove by 109 Northwest Road, Floyd Fischer refused to allow Tim to report the crime when he went to the Westhampton police department but offered to let Tim speak to him privately about the matter at his home. Ready to buy a home in Westhampton now?

But as you keep reading you will be disgusted to learn that of one of the players watching this lawlessness found himself in a unique position by moving into Westhampton and could have already stopped the lawlessness -- if only he were an honest, decent man.

Steve Gagne, the First Assistant District Attorney of Hampshire County lives in Westhampton and is involved in multiple Town boards. Westhampton has under 2,000 residents, so everyone on a Town board knows what is going on in Town. In fact, Steve tried to make political points by speaking at the May 2017 public sawmill hearing and writing an e-mail asking for executive session notes about the sawmill to make it look like he's "resisting" the criminals. Steve really thinks he is smart so we'll humor him and call him Smart Steve.

It seems contradictory then, when Smart Steve was sent information about Attorney Patrick Melnik's criminal conspiracy involving Chuck Miller, Smart Steve asked to be taken off the mailing list. Why would Assistant District Attorney Steve Gagne specifically refuse sworn deposition testimony showing felonies being committed in his home town? The town he raises his wonderful 5 and 10-year-old children in? One would think a "law enforcement" officer would want laws enforced, right? Well, an honest law enforcement officer would, but that's not who Smart Steve is. He is a criminal.

PC (Pathetic, Clueless) PHIL + CRUMBLES SCHWALLIE BLAME KP LAW FOR ERRORS ON SPECIAL PERMIT YET REFUSE TO INVESTIGATE KP LAW FOR THE ERRORS

1. The Chairman of the Westhampton Select Board and the Chairman of the Westhampton Planning Board testified under oath that no one from Westhampton's Town government is responsible for the fatally flawed court documents submitted for Judge Agostini's signature for the fraudulent special permit issued by his Court.
2. Nine months ago a Westhampton resident wrote to the three stooges (Westhampton Select Board) pointing out the fatal flaws of the Special Permit that PC Phil now blames solely on KP Law and the Westhampton Planning Board. Attorney Crumbles of the Planning Board also testifies he is not responsible for the special permit language - only KP law and Patrick Melnik, Sr. are responsible according to the Depends wearing attorney. Apparently, all of the little liars are going to play musical chairs of blame – how cute! What do you want to bet KP Law is going to blame PC Phil and Crumbles?
3. PC Phil states under oath he did nothing to investigate the facts presented about KP Law’s malpractice and simply sent the letter to KP Law. One of those claims was as simple as showing that Lot 26 was included on the site plan, but not included on the Special Permit. The reason Cotton hasn't been infecting our neighborhood is because even he understands the Special Permit is useless to him. So then, why is PC Phil still spending your money on a losing cause? Because little, broken people like PC Phil and Alcoholic Art are continuing this lawsuit for personal revenge against those who would dare question their authority. They do so with your money. They would NEVER still be in this lawsuit (nor would any sane person) if they had to spend their own money.
4. As you read PC Phil's deposition, you will see that he is a very disturbed individual. Phil has no shame in admitting that as the Chairman of the Westhampton Select Board he allowed an attorney (Katie Laughman, who has only managed to reach the level of associate after 15 years of practice) to tell him they would lose the case to Cotton and never asked why. That is the opposite of leadership, little boy, but you have never successfully led anyone or anything ever; have you? You will read where Phil admits to lying to the entire Town on May 23, 2017, but when confronted, says he didn’t lie – he claims what he said was "inaccurate." Phil, any sane person calls that a lie -- other than Bill Clinton – yes, we know, one of your slimy, fellow misogynists. Why don’t you tell residents how you couldn’t figure out how to investigate raw sewage across from an elderly woman’s home or the incessant ringing of a fire truck horn which tormented the same elderly woman? PC Phil stood by and let a little old lady literally get “sh-t” on every time she breathed -- like any little patriarchal misogynist. All of those complaints were about a campground owned by a fellow male Town official – see how the Cialis Crew works?
5. Phil claims throughout his deposition, he knows nothing - he's clueless which brings his standing up from just “pathetic” to a full PC. That’s what PC means, right, Phil? But if this liar "feels" that you misquoted him (or he misquoted himself!) verbally or even in writing, then PC Phil amazingly remembers every single word. Read any books about Narcissus recently, little snowflake? When Turtleboy Sports asked why Westhampton had "crooks" being able to use Town buildings, they didn't know PC Phil's wife worked at the library while PC Phil oversaw the finances of the library and Town. Things will make sense to the outside world once the Cialis Crew become really, really famous.
6. Instead of investigating KP Law or notifying the Court that Judge Agostini had signed fraudulent paperwork, PC Phil and the other two stooges have continued to engage KP Law as our Town Counsel for the last nine months. They have done so even though both the Chairman of the Westhampton Select Board and the Chairman of the Westhampton Planning Board have both blamed KP Law and Patrick Melnik, Sr. for the creation of the fraudulent documents. The reason it took so long to get the truth is because KP Law, Melnik and the AG all filed separate motions to delay depositions using your tax money so their fraud would not be uncovered.
7. Based on the testimony of Dowling and Schwallie, KP Law is guilty of legal malpractice, at a minimum. The Select board of Westhampton must fire them and recover our tax money through a malpractice lawsuit. To not fire KP Law and seek recovery of our tax money, after blaming KP Law under oath, proves the Select board is complicit in this conspiracy.
8. In other words, Cialis Crew, you could very well lose your municipal immunity if your actions don’t follow your words. Sorry, what that means is that you get to pay your own money for your crimes instead of using our money to hide behind. Yeah, but don’t worry. You guys are very powerful. You’ve been doing this for decades. You all feel very important in Westhampton and tell each other that; and, like the saying goes: If you can make it in Westhampton, you can make it anywhere – or something like that; right, Cialis Crew?

HUSTON + PICHETTE + DOWLING + QUINLAN = CONTEMPT OF COURT

On May 23, 2017, the Selectmen of Westhampton announced they were putting a commercial sawmill on Northwest Road and that if anyone was upset by that illegal act, they could go to court and appeal.
What Pathetic Phil, Alcoholic Art and Mumbles Mark Schwallie didn't tell you at that public meeting was that they would use the power of YOUR government to help Dave Cotton attack you if you dared to seek justice and expose their crimes.
In June 2017, weeks after they told you in a public meeting that you could appeal, Phil, Art and Jim Huston, authorized the Westhampton Police Department to raid a Northwest Road homeowner's property based on an ANONYMOUS COMPLAINT that the owner was "living" there. Why would Pathetic Phil, Gossipy Jim and Alcoholic Art attack this man using the full force of your government and do so for the benefit of Cotton and the sawmill? Because they think they can get away with it and that you won't find out what reprehensible, lying cowards they are. Was this victim accused of a crime and that's why the police raided his home? No. Dave Cotton's lawyer and Jim, Phil and Art ordered the police raid to help them cover up their crimes. Read that again. If that doesn't infuriate you, you're not breathing.
The man they are attacking is "you" if you own property in Westhampton. This man's only "crime" is that he bought a home on a quiet residential road in 2010 and devoted years to improving the property; turning it into a buccolic, verdant, peaceful retreat. This man has brain cancer and is actively undergoing chemotherapy. This man does not want his home value to be destroyed by the sawmill like Pathetic Phil wrote that it would be to the Gazette last year. Thanks again for that, Pathetic Phil!!
Pathetic Phil also used your tax money to have DELORES THORNHILL and TOM QUINLAN, JR. work with your Town Counsel to write up affidavits (at your expense) in support of a motion filed by Dave Cotton's lawyer to get this cancer patient's lawsuit thrown out - the very type of lawsuit they told you you could file at the May 2017 meeting. Your tax money, Town counsel, Police Department and paid Town employees and officials were used to attack and harass a person just like you in Westhampton. If you think Art Pichette, Phil Dowling and Jim Huston wouldn't do the exact same thing to you if it was a different topic, you are so wrong -- just go ask Athanasiou, Powers, Curtis or Zimmerman to name just a few of their other victims.
During October 2017, THREE residents filed signed complaints with the Selectmen and the building inspector about Cotton violating the terms of the Special Permit. They even read the violations of the Special Permit into the record in front of the Selectmen and CHERYL PROVOST. Quinlan claims that CHERYL PROVOST never gave him the letters that were read aloud in front of Dowling, Cheryl Provost, Pichette and Huston on 10/2/17. (Why does Cheryl Provost still work for our Town if she consistently "loses" documents about the sawmill? And what exactly is Patricia Cotton's relationship to Dave Cotton? Did Patty Cotton, in fact, resign and was then re-hired because of issues regarding the sawmill? Is Patty Cotton's alleged negligence the ONLY "reason" Town counsel said we would lose the lawsuit? Why did Patty Cotton stop working for the town of Easthampton recently? Bob Dragon stated under oath that he was never given any reason by the Town attorney why we would lose.)
TOM QUINLAN NEVER CONTACTED ANY OF THE THREE RESIDENTS ABOUT THEIR COMPLAINTS. INSTEAD, QUINLAN CLAIMS TO HAVE NEVER SEEN OR HEARD OF THE LETTERS WHEN HE SPOKE TO COTTON WHO TOLD TOM HE HAD NOT VIOLATED THE LAW!!!
Tom Quinlan, Jr., following in the footsteps of the other criminal building inspector, Chuck Miller, has ensured that Dave Cotton has never been fined a penny by a Westhampton building inspector regardless of formal cease and desist orders and now this, breech of contract. Your taxes went up last year because of all of the legal bills we have to pay to keep the selectmen and their lawyers out of jail and the hundreds of thousands of dollars in fines the Selectmen illegally refused to collect against Dave Cotton!!! More importantly, our new criminal building inspector and Delores Thornhill have been asking to be rewarded for their storm trooper tactics with pay raises and health insurance coverage they want you to pay for -- so maybe they can come and raid your home in the future? Apparently, Art Pichette, Jim Huston and Phil Dowling need to make sure their Gestapo is well fed and cared for in Westhampton by giving gifts (from your tax money) to those who do their bidding!! But like all criminals or wannabee dictators, these idiots didn't think they would get caught!
Thomas Quinlan, Jr. is in Contempt of Court as are Alcoholic Art, Pathetic Phil and Gossipy Jim Huston. They have all violated a Judge's order while at the same time using your tax money to help Dave Cotton's lawyer harrass a Westhampton homeowner with a frivoulous motion that Melnik didn't even know how to file in court correctly. Katie, the Town attorney who gets paid with your tax dollars, stood next to Melnik in court supporting his failed, frivolous motion. Read that again. The Town attorney who you were told was "fighting" against Cotton in court prior to May 2017 is actually working hand in hand with Cotton's lawyer to defeat opposition to the sawmill using your tax money so your property values can be destroyed just like Pathetic Phil wrote about!!
Funnily enough, none of the Cialis Crew has shown their face in court to watch KP Law lose all of their oral arguments. The victims of their crimes are forced to go each time and watch their tax money pay a losing attorney try to cover up their crimes. Again and again and again.
Hey, Pathetic Phil, do you think you will go to court when ordered by a judge to explain your contempt for his court order? Hey, Alcoholic Art, do you think the Town should have to pay your legal fees for being in contempt of a court order? Hey, Gossipy Jim, do you think the judge will give you any leeway on your contempt charges when he sees that the lawyers in this case lied to the court and committed Fraud on the Court? As we all know, you’re not going to be able to run a Town illegally without a whole slew of supporters. As the authorities investigate the criminal Selectboard and Planning Board they will see the Cialis Crew’s most frequently used ploys to violate our laws.

With his 11/30/2017 letter Blowhard Bill trots out four of the most common tactics the Cialis Crew will employ to bend or break laws to get what they want for their friends and family.

• 1. If you don’t get what you want for your friends, schedule as many meetings as possible until no one in opposition shows up and then vote. Blowhard Bill, after many meetings on 109 Northwest Road, states: “The first two remedies I have been able to come up with are to have a special Town meeting …” Good job, Blowhard Bill, you’re following the playbook!


• 2. If the facts and the law are against what your friends want, attack the law and say that it doesn’t mean what it says or that the law is simply wrong. Blowhard Bill states: “As a member of the Zoning Board of Appeals I feel the negative decision we issued was technically, LEGALLY, and morally WRONG.” Because when Blowhard Bill was trimming the lambs’ hooves, he must have been studying case law and found that our by-laws are wrong, right, Blowhard? If you want a good laugh one day, come to a Town meeting and listen to uneducated lunatics tell you what the “spirit” of the law really is or what they “really meant” when they drafted the laws.


• 3. Whenever there is a court case that the Cialis Crew wants to lose, they will tell people they think we will lose regardless of the facts. Whenever there is a court case that the Cialis Crew wants to win, no matter how much the facts and the law are against them, they will drag on lawsuits for years and spend tens of thousands of taxpayer dollars hoping the other side will give up (see Athanasiou and Cotton cases). Blowhard Bill states: ”Also, if it does go to court, I feel quite certain that the town would loose (sic) and then we would end up paying not only our portion of the legal costs, but probably the appellant’s costs as well … ALL OF THIS SEEMS LIKE A TERRIBLE RISK TO TAXPAYER MONEY FOR NO GOOD REASON.” Yes, the sheep farmer feels we will loose (sic) because his legal opinion is as valuable as his ability to spell. He then goes to speak at length about the suffering and horror these poor innocent “victims” at 109 Northwest Road have had to endure because they broke our laws with their friend, Chuck Miller.


• 4. If you don’t feel you will get what you want at a meeting, have people from other towns come to the meeting to argue with and intimidate residents. Blowhard Bill states: “Based on the support shown at the public hearing, I am quite sure that endorsement could be forthcoming.” Of course, Blowhard Bill doesn’t mention that the Westhampton police had to intervene between Blowhard Bill’s “supporters” and the legal residents of Westhampton for the safety of the Westhampton residents. Two ladies over the age of 70 had to be escorted to their cars after the meeting because they were fearful for their safety. Yet Blowhard Bill thinks we should have another meeting just like that. What do you call a “man” that thinks it’s acceptable to have little old ladies intimidated and publicly states that he wants to see it happen again?

Next we can look at Blowhard Bill’s endorsement of Dave Cotton’s sawmill on 4/15/14. Blowhard Bill starts off by telling us what he considers wisdom: ”I think it would be wise to insure (sic) that the promises that have been stated are accomplished.” Since Cotton never complied with the Cease and Desist order, does that demonstrate to the “wise” sheep farmer that Cotton can’t be trusted? Hell, no!! Blowhard Bill is still an ardent supporter of the sawmill conspiracy. What is striking in this letter is that Blowhard Bill doesn’t even mention the two 80 year old victims of financial exploitation. Blowhard Bill talks about MORALITY regarding 109 Northwest Road which involved no crimes, but when talking about two 80 year olds who have been robbed blind, their victimization doesn’t merit a peep from Blowhard Bill. Apparently Bill follows some sort of unexplainable, unwritten moral code which allows him to tell people, as a Town official, what “laws” in our town are “WRONG” and what morality is.

Blowhard Bill is also our paid Town Moderator. Since he loves to talk about Westhampton (like he did with his really cute story about pig farmers on Northwest Road at the sawmill hearing) make sure you ask him how much taxpayer money was spent on lawyers for his failed bid to put up a solar project on his farm for HIS FAMILY TRUST when the town had no solar laws (see Rules 2 & 3 above). Ask him how many special meetings were scheduled that residents were forced to attend as Blowhard scurried to make more money for his family (see Rule 1 above). Ask him how many people he and his family invited to the meeting from other towns to argue with Westhampton residents (Rule 4). Ask him how any of that was good for Westhampton and then you’ll understand how the Cialis Crew works!

Take a look at how Blowhard Bill got his sawmill permit. Yes, that is the entire file. We’ll leave it up to the readers to see how many laws were violated in giving him this sawmill permit. I guess if you’re a rich, white landowner in Westhampton (this parcel alone is 145 acres!) the peon taxpayers are there to fund the Town attorney for whatever the Cialis Crew wants for themselves and their friends and if there are any laws in the way, those can be ignored or called “wrong.”

Next, we will feature a true genius within the Cialis Crew. This guy is so smart that he was able to buy a piece of residential real estate. He then applied for a $200,000 mortgage on the property, but was denied. 29 days later, he was approved for an $826,000 commercial mortgage from the same bank for the exact same property. Why would the same bank deny a person a $200,000 mortgage and then 29 days later give them over 4 times that for the exact same piece of land? Silly you, you’re not a member of the Cialis Crew!! The Planning Board was made up of 5 members. Donald Coffey recused himself from all of the Planning Board meetings on the sawmill - that left 4 members. Here you will see billing entries from KP Law showing that Planning Board Chairman "Mumbles" Mark Schwallie knew in March 2014 that another Planning Board member had a conflict of interest. Mumbles received paid legal advice from Town Counsel about how to hold hearings with only THREE members. However, none of the four remaining board members ever recused himself. Hey, Mumbles, glad KP Law made their invoices so detailed? You're kind of like the simple minded thief that drops his driver's license in a home while robbing it; aren't you? :-)

That means Mumbles conducted ALL sawmill meetings from March 2014 onward knowing a board member had a conflict. That means the tens of thousands of dollars spent on the sawmill legal expenses are all based on meetings that should not have occurred with four members. We wonder if that board member had a conflict because he owns a gravel business and Cotton claims he had a gravel business and/or if he is the board member who committed adultery with one of the abutters' parents?

What that also means is that KP Law was fully aware a board member had a conflict in 2014. To this day, KP Law has made no public notification of this ongoing conflict that they provided legal advice on four years ago. How did FOUR board members vote to deny this sawmill application TWICE when there should have been only THREE members voting? Why did KP Law allow this to continue for years?

So, Mumbles, why don't you call Special Investigator Brian McWilliams at the Massachusetts State Ethics Commission on his direct number at 617.371.9520. He has the complaint against the Town and has stated that he will act upon any clear evidence regarding conflicts of interest in Westhampton. You, or anyone, can report yourself or the board member who wasn't recused. Maybe they could offer you some leniency for cooperating. But, then again, maybe no one will find out what you did, right?

Mumbles, you and your friend had your fun lying to us and wasting so many nights of our lives. You made adults sit through 15 meetings that were all based on a lie. You talked about wearing Depends to drive your daughter to boot camp. Remember the NASCAR delay idea; that was brilliant; wasn't it? You talked about how this whole process is "killing" you. Losing your law license and going to prison may do that, but kindly remember that you guys willfully chose to defraud the nice residents of Northwest Road.

If it's any consolation, we're heartbroken up here that committing crimes is tough on you! 9 Maybe you and your kids can get some nice relaxation at your $800,000 Wellfleet retreat this summer while the little peons on "not so nice" Northwest Road suffer as their peace and quiet is destroyed by the noise from the sawmill - just like Pathetic Phil wrote that it would be. UNDERSTANDING THE CRIMINAL GANG OF WESTHAMPTON
Pathetic Phil Dowling, Alcoholic Art Pichette and Gossipy Jim Huston continue to wage lawfare against residents of Westhampton in their quest to help Dave Cotton perfect his taking of $400,000 of land from a little old lady and to ensure that property values on Northwest Road are destroyed. The Westhampton Select Board operates as a criminal gang identified as the CIALIS CREW. The CIALIS CREW is hard at work continuing their attempt to keep their crimes hidden from law enforcement by using your tax money and Town assets to financially drain law abiding residents in court.

The sad thing for Westhampton taxpayers is that pathetic Phil has already publicly admitted to breaking our laws over the sawmill, so the Town loses automatically at trial. The only reason there is anything going on in courts is because Phil, Art and Jim continue to selfishly waste your tax dollars to cover up their crimes and prevent the truth from coming out. Eventually the criminal activity of people like Tom Hathaway, Mark Schwallie, Richard Tracy, Alcoholic Art, Gossipy Jim and Pathetic Phil will bankrupt Westhampton because judges don't rule in favor of criminals and criminal conspiracies as the conniving, lying misogynists find out with each new court ruling.

Hey, CIALIS CREW, think you're real men helping someone take land from an old lady or letting another old lady on Northwest Road be subject to your gang meetings meant to silence and intimidate? You, like all bullies, are a bunch of cowards that feel power when in a group. Just like all cowards, you will cry like babies when you suffer the legal consequences of your crimes. You guys thought Harry would save the day for you; didn't you? Harry Jekanowski's rulings and behavior in this case demonstrate either complete incompetence or that he is another criminal member of the CIALIS CREW. There are no other legal explanations for his rulings and behavior in this case. Harry won't remain clerk of courts after this case is examined by law enforcement.
